Save Girls’ Sports Act

The Save Girls Sports Act mandates that all athletic teams sponsored by public secondary schools and state higher education institutions in West Virginia must be designated based on biological sex as determined at birth.

Teams are classified as male, female, or co-ed/mixed. The Act prohibits biological males from participating on female-designated teams in competitive or contact sports, ensuring that athletic opportunities for biological females are protected.

The law establishes a cause of action for students who believe this policy has been violated, while protecting the privacy of minor students. The State Board of Education and higher education governing bodies are tasked with promulgating rules to implement these provisions.

Why We Support This Bill

We support the Save Girls Sports Act because it acknowledges the important biological differences between males and females, which are key to providing fair and equal athletic opportunities for girls and women.

By requiring sports teams to be designated by biological sex and keeping biological males from competing on female teams, the Act protects the integrity of women’s sports and the opportunities female athletes have worked hard to earn.

This law promotes fairness by creating a level playing field where female athletes can compete and succeed without being at a disadvantage. It also prevents biological males from having unfair scholarship opportunities simply by playing on female teams.
