Senate Bill 546 (2023)

Senate Bill 546 adds several synthetic and potentially dangerous substances to West Virginia’s Schedule I controlled substances list, addressing the growing concern over unregulated products being marketed to children.

These substances, often chemically altered to skirt existing drug laws, are increasingly found in products such as candies, cereal bars, and gummies—items that appeal directly to youth.

The Family Policy Council supports this legislation.

Sold openly in smoke shops and gas stations, these products pose a serious public health risk due to their potency, unpredictable effects, and misleading packaging.

By reclassifying these compounds under Schedule I, SB 546 empowers law enforcement and public health officials to take stronger action against their distribution and sale.

Why We Support This Bill

Our organization strongly supports SB 546 because it prioritizes the safety and well-being of children and families across West Virginia. We are alarmed by the deceptive marketing tactics used to target youth with drug-laced products disguised as innocent snacks. The sale of these items in everyday locations like gas stations and smoke shops makes them easily accessible and dangerously normalized. By banning these substances and their sale in child-friendly formats, SB 546 closes dangerous loopholes and sends a clear message that our state will not tolerate the exploitation of children through chemically altered, illicit products.
